Our client took her vehicle to a service center that does quick oil changes. While they were changing her oil, she sat in the waiting room. Upon leaving the waiting area and walking back to her vehicle, she fell into one of the oil change pits injuring her leg and arm.
Initially, the insurance company claimed the client was negligent for her own safety for failing to see the oil pit prior to falling into it. They also claimed she was in an area of the business she should not have been in.
Attorney Thomas Perlberg filed suit and was able to show that proper safety guards were not in place to prevent the fall. Without the need for a trial, the case settled out of court for more than $87,000.
